These General Terms of Service and Contracting (hereinafter, the “Terms”) govern the contracting and use of the tourist accommodation services offered by ERIC VÖKEL BOUTIQUE APARTMENTS through the website https://ericvokel.com/ (hereinafter, the “Website”).
The Website is operated by the company ATELIER CAPITAL, S.L. (hereinafter, “Eric Vökel”), whose details are provided below:

You are hereby informed that Eric Vökel may periodically update these Terms. When changes are made, a notice will be published on the Website together with the updated version of the Terms. Any modifications shall enter into force upon their publication and shall not apply retroactively. 2. DEFINITIONS
Contract: A binding agreement between Eric Vökel and the Client governing the conditions of booking, stay, and use of the services offered by Eric Vökel.
User: Any person who visits the Website for informational, consultation, or limited interaction purposes, without necessarily making a reservation.
Registered User: A User who has created an account on the Website to join the Eric Vökel Loyalty Club and gain access to exclusive benefits, such as additional discounts on accommodation rates.
Client: Any individual or legal entity that makes a reservation through the channels made available by Eric Vökel and with whom the Contract is formalized.
Guest or Guests: Any person who actually stays in the reserved accommodation, whether the Client themselves or a third party designated by the Client, and who is subject to the house rules, apartment-use guidelines, and obligations established in the Contract.
3. WEBSITE DESCRIPTION AND SERVICES OFFERED
The Eric Vökel Website provides information about its apartments, enables users to make reservations, and facilitates direct contact with the team for inquiries or assistance. The apartments are designed to offer a comfortable and pleasant stay, with attention to detail and high-quality amenities.
Guest satisfaction is a priority. The Eric Vökel team is available to address questions and ensure a clear and satisfactory experience.
Access to the Website is free of charge for all Users.
4. BOOKING AND CONTRACTING PROCESS
4.1. Booking channels
Reservations may be made through the Eric Vökel Website, via authorized third-party platforms, or directly at the establishments. These Terms will be available on the Website and, where applicable, a link to them will be provided in the reservation confirmation email. In the case of reservations made in person directly at the establishments, efforts will be made to inform the guest of the applicable terms, although the physical delivery thereof may not always be possible.
4.2. Booking methods
Reservations made directly through the Eric Vökel Website may be completed in the following ways:
(i) As a guest: Allows the reservation to be made without the need to create an account.
(ii) Registered Users: Users may register on the Website using an email address and password, with the option to join the Loyalty Club and benefit from an additional 5% discount on the applicable rate.
The reservation options as a guest or as a Registered User, as well as the benefits of the Loyalty Club, are only available for reservations made directly through the Eric Vökel Website.
4.3. Booking Confirmation
The reservation shall be confirmed once the corresponding total or partial payment has been received, or when a payment guarantee has been provided by means of a credit card.
The reservation confirmation, sent by email, shall constitute the binding Contract between the parties and shall include the details of the stay, the reserved apartment, the dates, the applicable rate, and the services included. Such confirmation shall be accompanied by a copy of these Terms of Contracting or by a link enabling their consultation.
By making a reservation, the Client expressly agrees to be bound by these Terms, as well as by any specific rules communicated in the reservation confirmation, the apartment manual, and any other instructions provided by Eric Vökel.
5. RATES, PAYMENTS AND TAXES
5.1. Rates
The rates applicable to each reservation shall be those in effect at the time of contracting and will be displayed on the official Eric Vökel website or on authorized distribution channels. Such rates may vary depending on the booking date, the type of apartment, the duration of the stay, and the promotions in force.
There are different rate types, each with its own specific conditions:
(i) Non-refundable rate: The total amount of the reservation (100%) will be charged at the time the reservation is made. No changes or refunds are permitted in the event of cancellation, date modification, or no-show.
(ii) Flexible rate: Allows the reservation to be canceled or modified up to 5 days prior to the arrival date, provided the reservation was made under the “Free Cancellation” condition. Cancellation or modification must be requested by contacting our reservations team or the reception team of the corresponding building. After this period, free cancellation will no longer apply and charges may be incurred in accordance with the specific terms of the reservation.
(iii) Other rates or specific offers: Shall be governed by the particular conditions expressly indicated in the reservation confirmation (for example, long-term stays, temporary promotions, packages with additional services, etc.).
5.2. Payment
Accommodation prices include only the services expressly indicated in the reservation confirmation; therefore, any additional service requested during the stay will be billed separately.
Payment of the invoice must be made at the time indicated during the contracting process, and may be required in advance at the time of booking or upon check-in.
Payment may be made by credit or debit card (Visa or MasterCard) or in cash in local currency. However, in cases where check-in is completed through the self check-in machine, payment must be made exclusively by card, and cash payments will not be accepted.
The holder of the card used to guarantee the reservation must be present at check-in and verify their identity with a valid official identification document. If this condition is not met, the establishment may refuse the reservation or require a new valid form of payment.
Furthermore, Eric Vökel reserves the right to carry out a pre-authorization on the card provided by the Guest both to guarantee the validity of the reservation and to cover possible damages to the apartment or unpaid additional services. Where applicable, prior to arrival at the accommodation, the Guest will be informed of the corresponding amount to be reserved or deposited.
5.3. Tourist taxes and fees
The prices shown include the applicable Value Added Tax (VAT) in force at the time of contracting.
In certain cities, a tourist tax established by the local authorities will also apply, which must be paid directly by the Guest at check-in, unless otherwise expressly stated in the reservation confirmation.
Both VAT and, where applicable, tourist taxes and any other charges applicable under the legislation in force shall be passed on to the Guest and itemized on the final invoice provided at the end of the stay.
5.4. Supplies
All electricity, water, and gas supplies (as applicable to the establishment) are included in the apartment rate.
6. CANCELLATION POLICY
Depending on the rate selected at the time of booking, the following conditions shall apply:
6.1. Flexible rate with free cancellation
(i) No charge will be made to the card provided until the Guest’s arrival, with the card details being used solely as a guarantee for the reservation.
(ii) Reservations may be cancelled free of charge up to five (5) days prior to the arrival date.
(iii) In the event of cancellation after this period, or failure to arrive at the establishment on the contracted date, only the charge corresponding to the first night of the stay will apply.
6.2. Non-refundable rate
(i) The total amount of the reservation will be charged at the time the booking is made.
(ii) In the event of cancellation, modification of dates, or no-show, the full price of the reservation will be charged, with no possibility of refund or compensation.
7. PROMOTIONS AND DISCOUNTS
Eric Vökel may offer special promotions and additional discounts on certain reservations, with the purpose of rewarding customer loyalty and providing preferential access to its accommodations under advantageous conditions.
(i) “Flash Sale” discounts: Eric Vökel periodically offers additional discounts on certain apartments referred to as “Flash Sales,” generally every two (2) weeks for a period of approximately four (4) days. These discounts are automatically applied to the displayed rate during the promotional period, without the need to enter any code.
(ii) Loyalty discounts: Registered Users in the Eric Vökel Loyalty Club may benefit from an additional 5% discount on the applicable rate at the time of booking. To apply this discount, the User must be registered and logged into their Loyalty Club account.
The aforementioned discounts cannot be combined with other offers or promotions, unless expressly stated otherwise. Eric Vökel reserves the right to modify the conditions, dates, or availability of promotions at any time and without prior notice.
8. INCLUDED SERVICES
Eric Vökel offers Guests a wide range of services, some included in the reservation and others optional.
8.1. Reception and continuous assistance service
All our buildings have a reception area located on the main floor, where Guests can receive personalized assistance from our staff.
Our reception is open 365 days a year, from 9:00 a.m. to 5:00 p.m. In case of arrivals outside reception hours, the Eric Vökel team will contact you to manage check-in in a convenient and simple manner. To this end, we will send you all necessary information to complete registration through the self check-in machine located in the building. You must enter the information stated in your reservation confirmation into the machine.
Exception for Amsterdam Suites: In our Amsterdam building, we offer 24-hour reception service.
Each building also has an assistance telephone line through which a staff member will be available at all times.
Check-in will take place from 3:00 p.m. and check-out must be completed before 11:00 a.m. However, early check-in or late check-out may be requested, subject to availability and an additional charge.
At reception, you will find staff ready to assist you with anything you may need during your stay and to provide practical information about the apartment and available services.
8.2. Breakfast Basket
When booking through our Website, you will receive a complimentary Breakfast Kit. Delivery or collection of the kit will be arranged in the most convenient manner for the Guest and according to the specifications of the apartment.
If you have any food intolerance or special dietary requirements, please notify us in advance by emailing book@ericvokel.com so that we can offer you suitable alternatives.
8.3. Wi-Fi
We provide our Clients with complimentary Wi-Fi in the apartments. Access details can be found in the welcome letter next to the apartment telephone, and they may also be requested at any time from reception staff.
8.4. Safe deposit box
Each accommodation unit has a complimentary safe for Guests who wish to use it. The establishment shall not be held liable for the loss of items or valuables not stored in the safe.
8.5. Cleaning service and linen change
The apartment is delivered clean upon arrival and cleaned again every seven days, including a change of bed linen and towels. This service may be requested more frequently for an additional fee, depending on needs, either when booking or upon arrival. In any case, the corresponding price will be provided in advance based on the requested frequency and/or service needs.
8.6. Parking service
In certain buildings, we have agreements with nearby parking facilities, and our staff can provide information regarding conditions and rates.
Additionally, Eric Vökel Hamburg Suites and Eric Vökel Atocha Suites have their own parking facilities, available at an additional cost and subject to availability.
Eric Vökel shall not be held liable for losses, damages, or any incident affecting parked vehicles or any objects or belongings inside them.
8.7. Cleaning kit
Each apartment includes a kitchen cleaning kit with the necessary supplies to keep the facilities in proper condition.
8.8. Luggage storage service
All our buildings have lockers or designated areas to store luggage free of charge.
8.9. Laundry service
All apartments are equipped with a washer-dryer, along with operating instructions and complimentary detergent.
8.10. Bathroom amenities
Shower gel and shampoo are provided for Guests in each apartment.
8.11. Concierge services
We offer additional services to enhance our Guests’ stay, including ticket arrangements for leisure and tourist activities, local restaurant recommendations, information on local events, and assistance during check-in, available from 9:00 a.m. to 5:00 p.m.
9. GUEST IDENTIFICATION
The holder of the reservation and all Guests aged fourteen (14) or older must present a valid official identification document at check-in, in accordance with regulations governing the registration of travelers in tourist accommodations.
The Client must inform Eric Vökel of the total number of persons who will occupy the apartment at the time of booking, and only those persons may use it in accordance with the contracted terms. If more persons than initially communicated arrive and the apartment has sufficient capacity, the corresponding supplement must be paid in accordance with the applicable rates as informed by reception staff.
When making the reservation, the Client and/or Guest shall provide their name, email address, telephone number, and country of residence. Likewise, Eric Vökel reserves the right to request and obtain the same information from the other occupants of the apartment for registration purposes and to comply with applicable regulations.
Children under three (3) years of age may stay free of charge, provided they share the accommodation with the responsible adults.
With respect to pets, they will only be permitted upon express request and prior approval by Eric Vökel, with a maximum weight of 10 kg. In such cases, additional charges may apply, which will be communicated prior to acceptance of the reservation.
Under no circumstances may the number of persons accommodated exceed the maximum authorized capacity for each apartment. Failure to comply with this rule entitles Eric Vökel to immediately terminate the Contract, without the right to any refund of amounts paid and with the obligation to pay any applicable supplements or damages.
10. GUEST OBLIGATIONS AND CONDUCT
Eric Vökel is a Family-Friendly establishment, designed to offer a comfortable, safe, and peaceful experience for all Guests. For this reason, we request the cooperation of our Clients in complying with the coexistence rules and the proper use of the facilities.
It is strictly prohibited to disregard quiet hours, consume drugs inside the establishment or in its surroundings, or violate any other general condition for the use of the apartments. Failure to comply with these rules may result in financial penalties, partial or total withholding of the security deposit, or even immediate eviction without the right to refund the accommodation fees paid.
These measures are intended to protect the safety and well-being of all Guests, especially families with children.
10.1. Guest Obligations
The Guest undertakes to:
(i) Use the facilities responsibly and correctly, taking care of common areas and the apartment furnishings.
(ii) Maintain respectful behavior towards neighbors and other Guests.
(iii) Refrain from hosting parties, engaging in illegal activities, or generating disturbing noise, especially during night hours.
(iv) Respect the non-smoking policy in apartments and common areas, except in designated smoking areas if available.
(v) Not accommodate pets without the establishment’s express authorization.
(vi) Refrain from registering their residence at the establishment’s address. The apartments may not be used as a tax or legal domicile, nor for purposes other than temporary accommodation.
(vii) Be responsible for any damage caused to the apartment, furniture, facilities, or equipment, whether due to negligence, improper use, or by persons under their responsibility.
Serious non-compliance with these obligations may result in the immediate termination of the Contract, eviction of the Guest, and loss of amounts paid, without prejudice to claims for additional damages that may have occurred.
10.2. Prohibitions
10.2.1. Quiet hours
To ensure all guests' rest, quiet hours are from 21:00 to 09:00. During this period, noise is prohibited in apartments, terraces, balconies, and common areas.
We kindly ask Guests to report any incident that may affect nighttime rest so it can be resolved promptly. Compliance with this rule ensures a peaceful and pleasant environment throughout the stay.
10.2.2. Smoking prohibition and penalties
For safety and comfort reasons, smoking is not permitted in apartments, common areas, or the surroundings of the building.
In case of violation of this rule:
(i) A €250.00 fine will be applied for smoking inside the building.
(ii) If the alarm is activated and Fire Department intervention is required, an additional €1,000.00 penalty will be applied.
We kindly ask Guests to exercise caution and correctly use the installed safety systems, as these measures aim to protect everyone’s safety and avoid unnecessary risks.
Exception regarding Amsterdam Suites: At Amsterdam Suites, an additional €500.00 fine will apply for activating the smoke detector.
10.2.3. Maximum occupancy and visitors
The accommodation capacity cannot exceed the number of persons indicated in the reservation. Any excess occupancy, as well as the presence of unregistered visitors, shall constitute a breach of the reservation terms and may result in its immediate cancellation, the obligation to vacate the accommodation, and the forfeiture of all amounts paid.
11. ERIC VÖKEL'S OBLIGATIONS
Eric Vökel undertakes to provide its Guests with safe, comfortable accommodation consistent with the details of their reservation. Its main obligations include:
(i) Maintenance and operation: Ensuring that the apartments and facilities are in perfect working order, hygiene, and safety conditions at the start of the stay.
(ii) Repairs and breakdowns: In the event of a breakdown unrelated to the establishment or an issue caused by improper use of the apartment that makes it impossible for the Guest to continue the stay, Eric Vökel commits to resolving the incident as soon as possible after being notified by the Client. If it is not possible to resolve the issue, an alternative apartment of equivalent characteristics will be provided, thereby ensuring the continuity of the stay with minimal inconvenience.
(iii) Assistance and communication: Maintaining clear and accessible communication channels so that the Guest may report any incident during their stay and receive guidance or assistance promptly.
(iv) Accurate information: Providing complete and truthful information regarding the features of the apartment, available services, usage rules, and any relevant circumstances that may affect the stay.
12. LIABILITY AND EXEMPTIONS
Eric Vökel is committed to guaranteeing the quality and safety of the services offered. However, the following limitations and exclusions of liability shall apply:
(i) Loss or damage to personal belongings: Eric Vökel shall not be liable for any loss, theft, or damage to the Guest’s personal belongings that are not stored in the apartment’s safe or at reception, nor for damages arising from force majeure events such as natural phenomena, supply outages, strikes, or other circumstances beyond our control.
(ii) Use of the apartment by the Guest: Eric Vökel shall not be responsible for any consequences resulting from the Guest’s use of the apartment during their stay, including damages, injuries, losses due to theft, fire, or criminal activities.
(iii) Limitation of liability for improper use: Eric Vökel shall not be liable for any damage or loss arising from improper use of the accommodation services or apartment. The Guest must follow the instructions regarding use, maintenance, and conduct rules set out in Clause 10 of these Terms and Conditions. In the event damages occur due to improper use, Eric Vökel reserves the right to claim from the Guest the corresponding repair or compensation costs.
(iv) Exclusion in case of force majeure: Eric Vökel shall not be liable for any failure or delay in the performance of its obligations when such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, embargoes, acts of civil or military authorities, fires, floods, accidents, strikes, or shortages of transportation, energy, labor, or materials.
(v) Limitation of financial liability: In the event of any claim arising from the reservation or provision of the service, the financial liability of Eric Vökel shall be limited to the value of the contracted service. Eric Vökel shall not be liable for indirect, consequential, special, or punitive damages.
(vi) Pandemics and health emergencies: Eric Vökel shall not be liable for cancellations, modifications, service limitations, or any other failure arising from pandemics, epidemics, public health emergencies, or orders issued by competent authorities restricting mobility, accommodation, or the provision of tourism services.
13. MODIFICATIONS AND AVAILABILITY OF SERVICES
Eric Vökel may, for justified reasons, reassign the booked apartment to another of equal or superior characteristics, at no additional cost to the Guest.
Certain services (parking, luggage storage, laundry service, etc.) are subject to availability and may vary depending on the property. In all cases, any specific conditions will be communicated at the time of booking.
14. MINORS
Guests under eighteen (18) years of age must be accompanied by their parents, legal guardians, or duly authorized adults. Eric Vökel reserves the right to request supporting documentation.
15. RIGHT OF ADMISSION
Eric Vökel reserves the right of admission and to require guests to leave its premises, particularly in cases of breach of these Terms and Conditions or conduct that disrupts coexistence or safety.
16. PROTECTION OF PERSONAL DATA
In compliance with Regulation (EU) 2016/679 General Data Protection Regulation (GDPR) and Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights, Eric Vökel informs its Guests regarding the processing of their personal data:
Data Controller: ATELIER CAPITAL, S.L.
Purposes of processing:
(i) Management of reservations and provision of the contracted services,
(ii) billing,
(iii) compliance with legal obligations regarding security, and, where the data subject has provided express consent,
(iv) the sending of commercial communications related to Eric Vökel services.
Legal basis:
(i) Performance of the accommodation contract,
(ii) compliance with legal obligations, and, where applicable,
(iii) the data subject’s consent.
Data recipients: Public authorities and bodies in compliance with applicable regulations, as well as service providers necessary for the proper management of the stay. Where international data transfers are carried out, they will always be made with appropriate safeguards in accordance with applicable regulations, ensuring a level of protection equivalent to that of the European Economic Area.
Rights of data subjects: The data subject may exercise their rights of access, rectification, erasure, objection, restriction of processing, and data portability by sending a written communication to reclamacion@ericvokel.com or to the postal address of the Data Controller.

17. INTELLECTUAL AND INDUSTRIAL PROPERTY
All rights over the content published and provided on the Eric Vökel Website relating to the services offered are protected by copyright, sui generis database rights, as well as trademark laws and rights relating to the honour and reputation of individuals, companies and registered brands.
In this regard, the articles, databases, content, images, logos, analyses or other materials that appear on the Eric Vökel Website or that are distributed as a result of the contracted services are owned by Eric Vökel or by individuals or companies that have expressly authorised us to publish them, i.e., the rights holders of the corresponding exploitation rights. Likewise, certain content may be subject to licences allowing its use in accordance with the provisions of these Conditions or the Legal Notice of the Website.
Any partial or total reproduction of the content mentioned in this clause, by any means or on any medium, requires the prior and express authorisation of Eric Vökel, under the limitations and conditions established in our intellectual property policy and the Legal Notice of the Website.
Access to information or content on the Website does not grant any rights to reproduce, distribute or communicate such content without the consent or licence of the rights holder, whether Eric Vökel or third parties who have transferred such rights.
The unauthorised use of any of the aforementioned content is expressly prohibited, including any form of reproduction, distribution, public communication, transformation or any other form of exploitation that has not been authorised in writing by Eric Vökel.
Eric Vökel reaffirms its commitment to respecting the intellectual property rights of third parties. Any material included on the Website that is owned by third parties is used under the corresponding licences or authorisations.
18. INCIDENTS DURING YOUR STAY
In the event that the Guest detects any incident, damage, or malfunction in the apartment, furniture, facilities, or equipment during their stay, they must immediately contact Eric Vökel through the following channels:

The Eric Vökel team will address the issue and provide the necessary assistance to resolve it as soon as possible. Such assistance does not replace the applicable terms for cancellations, modifications, or claims related to the reservation, which shall always be governed by the specific policies of each booking channel (website, authorised third-party platforms, or on-site bookings).
19. OTHER APPLICABLE TEXTS
In addition to these Conditions, the Client agrees to comply with any other applicable texts and policies governing the use of the website or the commercial relationship, including, but not limited to, the Privacy Policy, the Cookies Policy and the Legal Notice.
Likewise, depending on the type of accommodation, specific additional conditions may apply, which shall be available for consultation both before and after the booking is made.
In the event of any conflict between the different policies and legal texts, the provisions specifically applicable to each situation shall prevail, in accordance with the terms set forth in each of the aforementioned documents.
Eric Vökel reserves the right to modify or update any applicable text or policy and undertakes to notify such changes to the User by publishing the updated versions on the website.
20. APPLICABLE LEGISLATION
These Conditions and the contractual relationship between Eric Vökel and the Client shall be governed by, and interpreted in accordance with, Spanish law.
21. JURISDICTION OR COMPETENT COURTS
21.1. For Legal Entities
21.1.1. Out-of-Court Dispute Resolution
21.1.1.1. In compliance with Organic Law 1/2025 of 2 January on measures to improve the efficiency of the Public Justice Service, the Parties shall attempt to resolve any dispute by means of the out-of-court mechanisms provided for in said law before resorting to judicial proceedings.
21.1.1.2. In connection with the above, the Client may file an out-of-court claim arising from its relationship with our Website or online services pursuant to the European ADR regulation for online commerce.
21.1.1.3. The list of consumer dispute resolution entities in the Member States, Norway and Iceland, along with their contact details, is available here: https://consumer-redress.ec.europa.eu/dispute-resolution-bodies.
21.1.2. Competent Jurisdiction
For any dispute arising from the validity, effectiveness, interpretation, application or enforcement of these Terms and/or any contractual relationship between Eric Vökel and the Client, the courts of Madrid shall have exclusive jurisdiction.
21.2. For Consumers
21.2.1. Alternative Dispute Resolution
21.2.1.1. Pursuant to the updated Directive on alternative dispute resolution adopted by the Council of the EU on 17 November 2025, consumers have access to formalised ADR mechanisms to resolve disputes with traders, including those arising from online contracts.
21.2.1.2. Consumers may resort to the EU-designated “Consumer Dispute Resolution / ADR” portal or to the officially notified ADR bodies in their country of residence (including mediation, arbitration or other mechanisms established under the applicable regulations).

21.2.1.3. Claims may be filed through the means established by each ADR body and shall be subject to the time limits and procedures set out in the 2025 Directive, including the requirement that the Provider respond within 20 days from notification of the case.
21.2.1.4. Alternatively, the consumer may always choose to bring an action before the ordinary courts to assert their rights.
21.2.2. Competent Jurisdiction
In the event of a dispute between the Parties in which the Client is a Consumer, the competent court shall be that of the Consumer’s domicile, in accordance with Regulation (EU) No 1215/2012.
